When the auditor's tools come from the same vendor as the system being audited, independence is compromised—not by intent, but by architecture.
Article 31(5) Requirements
Notified bodies shall perform their activities... taking due account of the size of an undertaking... in particular in view of their independence from providers of the AI systems...
Translation: You need tools that don't come from the AI providers you're assessing.
